Terms of Service

1. About These Terms

These Terms of Service ("Terms") govern your use of the Barunay mobile application and website (collectively, the "Service"). The Service is operated by Aijas Technologies ("we", "us", or "our"), a company registered in Brunei Darussalam.

By creating an account or using any part of Barunay, you agree to these Terms. If you do not agree, please do not use the Service.

2. What Barunay Is

Barunay is a super app that brings together marketplace, services, automotive, real estate, food discovery, delivery, and request-for-quotation features in one platform. We connect buyers and sellers, service providers and customers, and facilitate transactions between users in Brunei.

Barunay is a platform, not a party to transactions between users. We are not a marketplace seller, a service provider, a delivery company, or a bank.

3. Your Account

• You must be at least 16 years old to use Barunay.
• You must provide accurate information when creating your account.
• You are responsible for keeping your login credentials secure.
• One account per person. Sharing or selling accounts is prohibited.
• You must not impersonate another person or business.

4. User Responsibilities

As a buyer or customer:

• Pay for items and services you commit to purchase.
• Communicate respectfully with sellers and providers.
• Do not request off-platform transactions to avoid fees.
• Report issues honestly. False claims may result in account suspension.

As a seller or service provider:

• List only items and services you can deliver.
• Provide accurate descriptions, photos, and pricing.
• Fulfil orders and bookings in a timely manner.
• Respond to messages and requests promptly.
• Do not sell prohibited items (see Section 5).

5. Prohibited Activities

• Selling illegal, stolen, counterfeit, or restricted items.
• Posting fraudulent, misleading, or scam listings.
• Spamming, harassment, or abusive behaviour toward other users.
• Using the platform for money laundering or financial fraud.
• Attempting to hack, reverse-engineer, or disrupt the Service.
• Creating fake accounts or reviews.
• Using bots or automation to manipulate listings, ratings, or search results.

Violations may result in content removal, account suspension, or permanent ban without refund of any credits.

6. Barunay Credit System

Barunay Credit is a pre-paid balance used for featured listing placements and other premium features within the app.

• Credits are not real money. They are a digital balance for in-app use only.
• Credits cannot be refunded or withdrawn once added to your account.
• Credits are topped up via bank transfer with admin review. Proof of payment is required.
• If your top-up request is rejected, you may appeal within 7 days. The admin's decision on appeal is final.
• Credits have no cash value and cannot be transferred between users.
• We reserve the right to adjust or remove credits in cases of fraud or violation of these Terms.

7. Featured Listings

Sellers can use Barunay Credit to promote their listings as "featured" for increased visibility. When you submit a featured request:

• Credits are held from your balance upon submission.
• If your request is approved, credits are deducted and the feature goes live for the selected duration.
• If your request is rejected or cancelled, held credits are returned to your balance.
• Featured placement does not guarantee sales or engagement.

8. Transactions & Payments

Barunay facilitates connections between users but does not process payments between buyers and sellers. Payment arrangements are made directly between users unless otherwise stated for a specific feature.

For credit top-ups, we accept bank transfer only (other methods may be added in the future). You must upload proof of payment for admin review before credits are added.

9. Fees

Barunay is free to use for basic features. We may introduce fees for premium features (such as featured listings) in the future. Any fee changes will be announced in advance via in-app notification.

10. Content & Intellectual Property

You retain ownership of content you post (listings, photos, messages). By posting, you grant Barunay a license to display that content within the Service for the purpose of operating the platform.

The Barunay name, logo, and app design are property of Aijas Technologies. You may not use them without permission.

11. Privacy

Our handling of your data is described in our Privacy Policy. Please read it to understand how we collect, use, and protect your information.

12. Disclaimers

• Barunay is provided "as is" without warranties of any kind.
• We do not guarantee that listings are accurate, available, or safe.
• We are not responsible for the quality, safety, or legality of items and services listed.
• We are not liable for disputes between users, but we may mediate when reported.
• We are not liable for indirect, incidental, or consequential damages.

13. Account Suspension & Termination

We may suspend or terminate your account if you violate these Terms. You can delete your account at any time by contacting us. Upon deletion, your data will be removed in accordance with our Privacy Policy.

14. Dispute Resolution

If you have a dispute with another user, please try to resolve it directly first. If you need help, contact us at hello@barunay.com. For disputes with Aijas Technologies, we will work with you in good faith to resolve the issue. If we cannot resolve it, disputes shall be governed by the laws of Brunei Darussalam.

15. Changes to These Terms

We may update these Terms as Barunay grows. We will notify users of significant changes via in-app announcement or email. Continued use after changes means you accept the updated Terms.
